The American Bankruptcy Institute’s Commission on Consumer Bankruptcy was established in 2017 to address the social and economic shifts that have occurred since the last major amendments to the Bankruptcy Code, the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA), and to assess BAPCPA’s effects on the current state of consumer bankruptcy law. This Final Report of the Commission recommends nearly 50 discrete reforms to the consumer section of the Bankruptcy Code.
